Terms of Service

The rules that govern your use of ElevateBox’s AI phone-calling platform. Please read them carefully before hiring an AI employee.

1. Acceptance of these Terms

These Terms of Service (“Terms”) govern access to and use of ElevateBox’s website, dashboard, APIs and AI voice-calling services (together, the “Service”), operated by ELEVATESCALE TECHNOLOGIES PRIVATE LIMITED (“ElevateBox”, “we”, “us”). By creating an account, placing a call through the Service, or otherwise using it, you agree to be bound by these Terms and by our Privacy Policy. If you are entering into these Terms on behalf of a business, you confirm that you have authority to bind that business.

2. The Service

ElevateBox lets a business configure an AI voice “employee” that places and receives phone calls on its behalf — following up on leads, answering inbound calls, and logging the outcome of every conversation. ElevateBox provides the calling service, the AI and the dashboard; you provide the phone numbers, scripts, data and business context the AI employee acts on. We may add, change or retire features from time to time.

3. Eligibility and account registration

You must be at least 18 years old and able to form a binding contract to use the Service. You agree to provide accurate account and billing information, to keep your login credentials confidential, and to notify us promptly of any unauthorised use of your account. You are responsible for all activity that takes place under your account.

4. Acceptable use

You agree not to use the Service to:

  • Place calls to numbers you do not have a lawful basis to contact;
  • Harass, defraud, mislead or impersonate any person or business;
  • Transmit malware, or attempt to probe, scan or breach the Service’s security;
  • Resell or sub-license the Service without our written consent; or
  • Violate any applicable law, including telecom and data-protection regulation.

Our Acceptable Use Policy sets this out in more detail. We may suspend or terminate accounts that we reasonably believe violate it.

5. Calling regulations, consent and your responsibilities

Outbound and inbound voice calling in India is subject to telecom regulation, including rules on the National Customer Preference Register (NCPR/DND) and commercial communication frameworks issued by the Telecom Regulatory Authority of India (TRAI). Because you control who is called, what is said, and why, you are solely responsible for obtaining and maintaining any consent required to contact the numbers you upload, honouring opt-out and do-not-call requests, and ensuring your campaigns comply with applicable telecom and consumer-protection law. ElevateBox provides tooling to help — a do-not-call list, consent records and calling-hour limits that are checked before each call — but that tooling does not by itself guarantee compliance, and using it does not shift legal responsibility away from you.

6. Fees, credits and payment

ElevateBox runs on a prepaid wallet. You top up the wallet in advance through our payment processor, and calls are charged from it per minute at the rate shown on our Pricing page, rounded up to 30-second blocks. Phone numbers are charged from the wallet every 30 days while you keep them. Credits are held before a call is placed and settled at the actual cost afterwards. Fees are exclusive of applicable taxes unless stated otherwise. We may change our prices on reasonable notice; new prices apply to calls placed after the change. Our Refund Policy describes when a payment is eligible for a refund.

7. Call recordings, transcripts and your content

You retain ownership of the scripts, prompts, customer lists and other material you upload to the Service (“Customer Content”), and of the recordings and transcripts generated from calls placed on your behalf. You grant ElevateBox a licence to process Customer Content solely to provide, secure and improve the Service for you, as described in our Privacy Policy. You represent that you have the rights necessary to upload and use Customer Content through the Service.

8. Intellectual property

The Service, including its software, models, designs and trademarks, is owned by ElevateBox or its licensors and is protected by intellectual-property law. Nothing in these Terms grants you any right in the ElevateBox name, logo or platform beyond the limited licence to use the Service as intended.

9. Service availability and disclaimers

We aim for high availability but do not guarantee that the Service will be uninterrupted, error-free, or available at any particular time — voice calling depends on third-party telecom carriers outside our control. Except as expressly stated, the Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, ElevateBox will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from or related to your use of the Service. Our aggregate liability for any claim arising out of these Terms will not exceed the amount you paid ElevateBox in the three months preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold ElevateBox harmless from any claim, loss or expense (including reasonable legal fees) arising from your Customer Content, your use of the Service in violation of these Terms, or your violation of any applicable law, including laws governing consent to be called.

12. Suspension and termination

Either party may terminate these Terms at any time; you can stop using the Service whenever you like and ask us to close your account. We may suspend or terminate access immediately if we believe your use of the Service poses a legal, security or regulatory risk to ElevateBox or others. On termination, your right to use the Service ends, though provisions that by their nature should survive (including payment obligations, disclaimers and limitations of liability) will continue to apply.

13. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts at the location ElevateBox designates in its registration documents.

14. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will provide reasonable notice, such as an email or an in-dashboard notice, before it takes effect. Continuing to use the Service after a change becomes effective constitutes acceptance of the revised Terms.
