Is AI calling legal in India? Plain answers for owners
Is AI calling legal in India? Yes, if you follow TRAI's DND and DLT rules, take consent under the DPDP Act and say it is an AI. Plain answers for owners.

Key takeaways
- AI calling is legal in India; the rules are about who you call and why, not whether a person or AI speaks.
- Calling someone who enquired, about their enquiry, is very different from cold promotional calling.
- Promotional calls need registered numbers and headers under TRAI's DLT system; DND numbers need consent.
- The DPDP Act asks for a clear notice and consent for using someone's personal data.
- Saying it is an AI at the start is good practice and avoids misleading anyone.
The short answer
Owners ask us this every week, usually just before they go live. The honest short answer: there is no Indian law that bans AI voice calls. What the law cares about is the call itself. Who are you calling, did they agree, what is the call for, and are you being honest with them? Those questions apply whether a telecaller or an AI employee makes the call.
Below are the questions owners actually ask, answered in plain words. For the detailed rulebook, with DLT registration steps and the regulations in full, read our TRAI and DLT guide. This post is a quick explainer, not legal advice; for anything unusual, talk to a lawyer who knows telecom rules.
Can I call a lead who filled my form with an AI caller?
Yes. Someone filled your website form or Meta lead ad asking about your 2BHK flats, your coaching batch or your clinic. You call them back about that enquiry. This is the most common and lowest-risk use of AI calling. The person asked to be contacted, and the call is about what they asked.
Two cautions. Your form should say clearly that you will call them, ideally with a tick box. And stick to the subject: a call about their flat enquiry should not turn into a pitch for your other projects in a different city.
Note that the rules do not get stricter because an AI makes the call, and they do not get looser either. If a call would be fine for your telecaller to make, it is fine for an AI employee. If it would be a problem for your telecaller, using AI does not fix it. It just makes the same mistake faster.
Which calls fall under TRAI's commercial calling rules?
TRAI's Telecom Commercial Communications Customer Preference Regulations, 2018 (TCCCPR) split business calls into three rough types:
| Type of call | Example | What you need |
|---|---|---|
| Promotional | Festival offer to a list of past customers | Registered telemarketer route, a header registered on the DLT platform, no calls to DND numbers without consent |
| Service | Calling a lead back about their enquiry, renewal reminder | A relationship or consent; recorded consent where required |
| Transactional | Appointment confirmation, OTP, delivery update | Tied to a transaction the person started |
The DLT (Distributed Ledger Technology) system is where businesses register their identity, headers and consent templates with telecom operators. If you run promotional campaigns, it is not optional. Service and transactional calls have lighter requirements but still need a genuine relationship with the person.
Can I call numbers on the DND list?
Not for promotion, unless that person gave you explicit consent. The National Customer Preference Register (NCPR), which most people know as DND, lets anyone block promotional calls fully or by category. A customer who registered for DND but then filled your enquiry form has asked you to call about that enquiry, so a call about it is generally fine. Calling a DND number from a bought list to sell something is not.
TRAI has tightened enforcement. Senders caught making promotional calls from ordinary 10-digit numbers can have their phone connections cut and be blacklisted. That is a business risk far bigger than any campaign.
What counts as consent?
- A form where the person typed their own number and agreed to be called about a clear purpose.
- A sign-up register at your store or event, with a line saying you will call.
- An existing customer relationship, for calls about that relationship (renewals, service, appointments).
- Consent recorded through the DLT system, where your promotional calls require it.
What does not count: a number found on the internet, a list bought from a data seller, or a number a friend forwarded. Keep a record of where every number came from. ElevateBox stores consent records and checks them, your do-not-call list and your calling hours before every call; see do-not-call and consent.
What does the DPDP Act 2023 change for calling?
The Digital Personal Data Protection Act, 2023 covers any personal data you collect digitally, which includes phone numbers, names, call recordings and what customers say on calls. Its rules are being brought in step by step, but the direction is clear:
- Notice: tell people what data you collect and why, in clear language, when you collect it.
- Consent: get a clear yes for that purpose. Pre-ticked boxes and vague wording do not count.
- Purpose limit: use the data for the purpose you stated. A number given for a test drive is not a number for loan offers.
- Withdrawal: if someone says "don't call me again", stop, and make stopping as easy as agreeing was.
- Security and deletion: protect recordings and transcripts, and do not keep them forever without reason.
Do I have to tell people it is an AI?
We are not aware of an Indian rule today that specifically requires it, but we strongly recommend it, and our AI employees are set up to say so. A line like "Namaste, main ABC Motors ki AI assistant bol rahi hoon" (Hello, I am the AI assistant from ABC Motors) takes two seconds. Pretending to be a person can mislead a customer, and misleading people is a problem under consumer protection law whatever the medium.
In our experience most people do not mind talking to an AI assistant that is polite and useful. They mind being tricked. Offer a human call-back for anyone who asks.
Can I record AI calls, and at what time can I call?
Recording is normal for business calls, but a recording is personal data under the DPDP Act. Say at the start that the call may be recorded, keep recordings secure, and use them for quality and records, not for anything else.
On timing, call at reasonable hours. ElevateBox defaults to 9 am to 8 pm, and you can narrow that. Lenders should follow the RBI's fair practices guidance, which limits recovery calls to between 8 am and 7 pm. The settings are explained in calling policy.
A simple checklist before you go live
- Your enquiry forms say you will call, and why.
- You know which of your calls are promotional, service or transactional.
- Promotional calls go through a registered route with a DLT header, and skip DND numbers without consent.
- Your do-not-call list is uploaded, and anyone who says stop is added to it.
- The AI employee says it is an AI assistant and that the call may be recorded.
- Calling hours are set, and lending reminders stay within 8 am to 7 pm.
- You have a written note of where each list came from.
Frequently asked questions
Is it legal to use an AI voice to call customers in India?
Yes. No Indian law bans AI voice calls. The rules that apply are the same as for any business call: TRAI's rules on promotional calls and DND, consent and notice under the DPDP Act, sensible calling hours, and not misleading people about who is calling.
Do I need DLT registration for AI calls?
For promotional calls, yes: they must go through a registered telemarketer route with a header registered on the DLT platform. Calling a lead back about the enquiry they made is a service call with lighter rules, but you still need their consent and a record of it.
Can an AI caller call a number on DND?
Not for promotion without that person's explicit consent. If someone on DND filled your enquiry form, a call about that enquiry is generally fine. Never call DND numbers from bought or scraped lists to sell something.
Does an AI caller have to say it is not a human?
We are not aware of a specific Indian rule requiring it today, but you should. Saying "I am the AI assistant from your company" at the start avoids misleading anyone, which matters under consumer protection law, and most customers accept it.
Does the DPDP Act apply to call recordings?
Yes. Recordings and transcripts contain personal data. Tell people the call may be recorded, use the recordings only for the purpose you stated, keep them secure and delete them when you no longer need them.
